Банк России намерен решить проблему недобросовестных иностранных форекс-компаний, оказывающих услуги российским гражданам через интернет. Регулятор может пойти по пути установления требований к их сайтам, действующим в российском интернет-пространстве. Однако полностью решить проблему можно лишь на международном уровне вместе с финансовыми регуляторами других стран, поскольку полномочия Банка России на иностранные юрисдикции не распространяются.
Форекс-компании, зарегистрированные в иностранных юрисдикциях, по-прежнему являются проблемой и ЦБ всерьез намерен ее решить, заявил вчера зампред ЦБ Владимир Чистюхин. «Фактически весь их контакт с потребителем идет только через интерфейс. Трансграничные транзакции не отличаются от национальных. И часто потребители даже не знают о факте перевода средств за границу,— отметил он.— Что делать? Я думаю, что мы стоим на пороге правовой революции. Фактически речь идет о регулировании участников, находящихся в других юрисдикциях». По его словам, задача ЦБ как локального регулятора — защитить российского потребителя от нераскрытия информации и недобросовестных действий форекс-компании. Но в данном случае возможности Банка России ограничены, так как российское законодательство не является экстерриториальным. «Сейчас можно только заблокировать нежелательные сайты, и то только если их содержание противоречит закону»,— отметил он.
Проблему пытались решить путем принятия профильного закона 460-ФЗ. Он обязал форекс-компании зарегистрировать юридическое лицо в России, получить лицензию и вступить в саморегулируемую организацию (СРО). Лицензии в 2016 году получили шесть компаний. Им в составе СРО еще предстоит написать и согласовать в ЦБ стандарты деятельности. До этого запускать бизнес они не имеют права. Таким образом, легальная российская форекс-индустрия до сих пор заморожена.
После принятия закона, часть крупных международных компаний официально покинула Россию. Так, в конце 2015 — середине 2016 года о приостановке деятельности в России заявили эстонская компания Admiral Markets и крупный датский брокер Saxobank. Но недавно бывший сотрудник московского офиса Saxobank рассказывал «Ъ», что, несмотря на это, приток российских клиентов в компанию не сократился (см. «Ъ» от 16 декабря 2016 года). Сейчас, по оценкам участников рынка, в России услуги населению через интернет оказывают около 100 иностранных форекс-компаний. В 2016 году в ЦБ поступило 210 клиентских жалоб на форекс-компании, зарегистрированные в иностранных юрисдикциях.
Готового рецепта борьбы с иностранными форекс-компаниями не существует, признал господин Чистюхин. «Возможно, должны вводиться требования к сайтам, к тому, как раскрывается информация, как соблюдаются права потребителей,— отметил он.— И это, скорее всего, работа, которая должна осуществляться не национальным регулятором, а на международном уровне». Похожим путем пошли в США, приняв закон Додда--Франка (The Dodd--Frank Act, 21.07.2010), указывает председатель независимой финансовой комиссии FinaCom Plc (Гонконг) Петр Татарников. «Одним из важнейших положений закона был запрет иностранным брокерским компаниям обслуживать американцев,— рассказывает он.— Однако о нарушениях закона американские регуляторы узнают только по факту получения претензий. Налагают штраф, заносят в черные списки, жалуются локальному регулятору нарушителя». По его словам, закон худо-бедно работает только за счет авторитета американских финансовых регуляторов, с которыми многие боятся связываться.
Решать проблему необходимо на международном уровне, уверены эксперты. «Недавно было активное воздействие на регулятора Кипра CySEC со стороны Австралии и Канады, где занимался мошенничеством брокер бинарных опционов с кипрской лицензией. Жалоба ушла и в Европейскую комиссию по ценным бумагам,— приводит пример Петр Татарников.— И CySEC подчинился — ввел в этом году ограничение на деятельность брокеров с кипрскими лицензиями в иностранных юрисдикциях». Но такой подход реализуем только при тесном сотрудничестве регуляторов.
Узнать официальную позицию иностранных форекс-компаний не удалось. Ни в одной из десяти крупных иностранных форекс-компании, имеющих русскоязычный сайт и оказывающих услуги российским клиентам, на запрос «Ъ» не ответили.
